I think if you accept her gift you can't choose legend path.

anyone curious. Only Nocticula's profane gift can potentially stop the player from choosing legend

There doesn't appear any option to [kneel] for me in the dialog after Hepzamirah is dead. Is the an option only for the Trickster Mythic path (there is one dialog option that's hidden for me)?

No, I'm playing Azata and I did get the option to kneel and receive her gift. I choose friendly answers that praised her though. Maybe that influenced it?

Killing the queen nets you 50k xp if you do not want the achievement or the buff, but it is at the price of breaking your heart. Easily the saddest death in the game.
